3. Booking and Reservations
3.1 Booking Process
Booking a yacht entails:
- Being 18 years old or more
- Providing truthful and full details
- Making a deposit payment as outlined in the booking confirmation
- Accepting these Terms & Conditions
3.2 Confirmation
Your reservation is deemed confirmed only subsequent to payment receipt and our formal confirmation. We reserve the jurisdiction to decline service to any individual at our discretion.
3.3 Availability
Charters are reliant on the yacht's accessibility and favorable weather conditions. We will strive to meet your requested dates and times as closely as possible.
4. Payment Terms
4.1 Pricing
All fees are stated in $ and incorporate applicable taxes, except as expressly indicated otherwise. Prices are susceptible to changes without prior notice.
4.2 Payment Schedule
- Initial deposit: 50% of the aggregate charter fee due at the time of reservation
- Final amount: Payable 48 hours ahead of the charter's start time
- Incidental expenses (if any): To be paid following the charter's culmination
4.3 Payment Methods
We accept most credit cards, electronic bank transfers, and verified cheques. Securely encrypted systems manage our payment processing.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- If cancelling more than 72 hours ahead of departure: Total amount returned minus administrative fees
- If cancelling between 24 to 72 hours prior to departure: Half of the amount is refundable
- If cancelling less than 24 hours before departure: No reimbursement provided
5.2 Weather Cancellations
If inclement weather is deemed hazardous by our captain, options presented will include:
- Rescheduling the charter to an upcoming available slot without extra fees
- A full refund if rescheduling isn't feasible
5.3 Mechanical Issues
In the instance of mechanical issues with the designated vessel, we will endeavor to arrange a comparable substitute. Where substitution is not possible, a complete refund will be issued.
6. Safety and Conduct
6.1 Safety Requirements
All guests must:
- Obey all directions provided by the crew
- Use prescribed safety gear as necessary
- Inform of any health issues that may impinge on their safety
- Stay within the vessel's designated zones
6.2 Prohibited Items
The following are disallowed onboard:
- Glassware
- Illegal substances
- Weapons or firearms
- Excessive non-alcoholic drinks (beyond sensible consumption)
- Pets (unless pre-authorized)
6.3 Conduct
Travelers must behave courteously. We may terminate a charter prematurely without a refund if a passenger's demeanor presents a risk or hinders other guests' enjoyment.
7. Liability and Insurance
7.1 Our Liability
Our financial accountability is capped at the charter's paid value. We are not responsible for:
- Injuries incurred due to guest imprudence
- Loss or harm of personal items
- Indirect damages or those that are of a punitive or sequential nature
- Delays brought on by weather or other factors outside our purview
7.2 Insurance Coverage
We sustain a comprehensive marine insurance plan covering our fleet and operations. Clients should secure their own travel and personal insurance.
7.3 Assumption of Risk
Partaking in our yacht charters implicates an acceptance of the innate risks associated with marine activities, with participants assuming accountability for their safety and health.
8. Modifications and Itinerary Changes
Itinerary alterations, routes, or schedules may be modified due to conditions related to safety, weather, or operational necessities. We will exert all efforts to provide suitable replacement experiences.
9. Force Majeure
We bear no liability for delays, cancellations, or changes stemming from circumstances beyond our influence, including, but not bound to:
- Extreme weather phenomena
- Natural calamities
- Governmental mandates
- Harbour closures
- Vessel malfunctions
10. Privacy and Data Protection
Your private data will be managed in line with our Privacy Policy. Service usage constitutes an agreement to the data gathering and use as specified in our Privacy Policy.
